Using the ® Symbol

You do not have to identify your trade mark as registered but you can use the ® symbol or the abbreviation "RTM" (for Registered Trade Mark)

 to show that your trade mark is registered, the mark can be registered somewhere other than in the United Kingdom.

The ® symbol usually is usually placed on the right-hand side of the trade mark, in a smaller type size than the mark itself, and in a

raised (superscript) position; none of this is compulsory. If you do not have the ® symbol available, you can use the abbreviation "RTM".

You would break the law (Section 95 of the Trade Marks Act 1994) if you use the registered symbol ® or the abbreviation "RTM", on a mark

 that is not registered anywhere in the world.

Benefits of registration

Registering your trade mark gives you the exclusive right to use your mark for the goods and/or services that it covers in the United Kingdom (UK).

If you have a registered trade mark you can put the ® symbol next to it to warn others against using it.

However, using this symbol for a trade mark that is not registered is an offence.

may put people off using your trade mark without your permission

makes it much easier for you to take legal action against anyone who uses your trade mark without your permission

allows Trading Standards Officers or Police to bring criminal charges against counterfeiters if they use your trade mark
